Should local inmates at the Orange County Jail be receiving kick-backs from local bail agents for referrals? This activity known as ‘capping’ is allegedly rampant in the Orange County Jail. Such solicitation for services is illegal, and inmates are telling the Orange County Bail Agents Association that jail personnel are aware of the activity, but doing nothing to stop it. Brian Malone Bail Bonds boasts 20 years of experience on his advertisements inside the Sacramento County Jail where he was using bulletin space to lure his victims. At least five inmates have accused Brian Malone of taking their money. The only problem, Brian Malone is not a license bail bondsman. Malone is an alleged criminal himself, charged with several felonies including falsifying and forging government documents and operating without a license. California Bail Bond Agents File Suit Against Orange County Sheriff

Appointed Orange County Sheriff Sandra Hutchens is at the center of a federal lawsuit alleging “capping” in Orange County prisons, a practice where inmates refer (often through threats of violence) business from other inmates to certain bail agents who then give the original inmate a portion of the bail amount. The suit also includes former sheriff Michael Carona and ex-assistant sheriff George Jaramillo, as the scheme was alleged to begin under Carona’s time as sheriff as well.
